Important Insurance Operations Responsibility

It is crucial to understand that your insurance organization is wholly and solely responsible for insurance coverage decisions, claims adjudication, and member benefit determinations. Maintaining proper underwriting standards, claims processing accuracy, and regulatory compliance is your organization's duty and obligation. Lnkr is a technology company. We simply aim to assist your insurance organization in managing operations and providing better service to your members and network providers. We do not -and do not intend- to make insurance coverage decisions or provide actuarial guidance.

Insurance Authorization Required

The Services are not intended for use by organizations that are not legally authorized to operate as insurance companies or health plans. By agreeing to these Terms, you represent and warrant to Lnkr that your organization is legally licensed to conduct insurance business and manage health plan operations in applicable jurisdictions. You agree that materials available through our Services are for operational and administrative purposes only, and do not act as a substitute for professional actuarial analysis or insurance industry expertise. The information and Services on this platform are provided to support insurance operations and should be used in conjunction with proper insurance protocols and regulatory requirements.

2. License

By using our Services, we hereby grant your insurance organization a limited, revocable, non-exclusive, non-sub licensable, right to: (i) access, upload and use our platform for the sole purpose of using our Services in your insurance operations; and (ii) access and use information and materials provided, made available or otherwise found on our Content.

This license is not intended to be sub-assigned, sold, rented, leased, exported, imported, distributed, transferred or otherwise granted to third parties outside of your authorized organizational users, nor is such license intended for commercial use beyond your insurance operations.

4. Organizational Registration and Access Management

In order to access the insurance features of the Services, your organization will need to register with Lnkr and create an organizational account through the online registration process. Your account gives your insurance organization access to the Services and functionality that we may establish and maintain from time to time and in our sole discretion.

Registration Requirements

In creating an organizational account, you must provide Lnkr with accurate and complete registration information about your insurance organization. You must promptly notify Lnkr if any of this information changes. Upon completing your organizational data registration, this means that you have an active organizational account on our platforms. To use our Services, you will need to sign an "Insurance Partner Agreement" and submit appropriate licenses, certifications, and regulatory authorizations proving your organization is duly authorized to operate as an insurance company or health plan.

Access Security and User Management

  • Your organization must maintain secure access credentials for all authorized users
  • Administrator passwords must be kept confidential at all times
  • Never respond to requests for passwords, especially from alleged Lnkr employees
  • Lnkr employees will never ask for your passwords
  • Your organization is responsible for all use of organizational accounts and user access
  • Multiple consecutive login failures may result in account suspension
  • You must manage and monitor all user access within your organization
  • Role-based access controls should be implemented based on job functions

You must notify Lnkr immediately if you believe your organizational account or any user credentials have been obtained or accessed by any unauthorized person or entity.

5. Communications Consent

By registering as an organizational user and providing Lnkr your contact information, you consent to our using this information to send you Service-related notices, including any notices required by law, system updates, security alerts, regulatory updates, and relevant insurance industry communications. You may opt-out of non-essential communications while maintaining necessary system and security notifications.

6. Third-Party Integrations

The platform may integrate with third-party systems including healthcare providers, pharmacy networks, claims clearinghouses, or other insurance technology services that are not owned or controlled by Lnkr. Lnkr has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party systems or services.

Important: Important: If your organization integrates with third-party systems through Lnkr's platform, you do so at your own risk and must ensure compliance with all applicable insurance regulations and privacy laws. You expressly release Lnkr from any and all liability arising out of your use of any third-party integrations or services.

7. Organizational Data and Member Information

By using our Services, your organization provides us with information, files, and data that you submit to Lnkr (together, "your organizational profile" and "organizational data"), including member information and claims data.

Data Usage Rights

By uploading, storing or transmitting any content through the platform, your organization grants Lnkr the necessary rights to process, store, and manage such data to provide the contracted services. All member health information and claims data remains subject to applicable privacy regulations including HIPAA and state insurance privacy laws.

Insurance Data Management Agreement

You understand and agree that the relationship between your organization and Lnkr includes data management services to gather, process, secure, and manage insurance and member information in compliance with applicable regulations. Your organization has provided this data to Lnkr for the purpose of delivering contracted insurance technology services.

  • Your organization retains ownership of all organizational and member data
  • Data retention policies will be governed by your organizational agreement
  • You are responsible for ensuring authorized personnel access to sensitive data
  • Your organization must maintain compliance with all insurance and privacy regulations

8. Key Organizational Responsibilities

Data Accuracy and Regulatory Compliance

Your organizational data, licenses, and regulatory authorizations must be accurate, complete and updated at all times. Your organization must maintain compliance with all applicable insurance regulations, state laws, and federal requirements. Failing to do so, you acknowledge that Lnkr has the right to suspend or terminate your use of the Services.

Account Security and User Management

  • Your organization must maintain secure access controls and user management policies
  • You are responsible for all activities performed by your authorized users
  • You must immediately report any suspected security breaches or unauthorized access
  • Organizational accounts cannot be transferred to other companies without proper authorization
  • Regular security audits and access reviews should be conducted
  • Claims processing staff should have appropriate access limitations

Insurance Regulatory Compliance

  • Maintain compliance with state insurance regulations and licensing requirements
  • Ensure proper Business Associate Agreements are in place for health information
